Types Of Sexual Harassment Under Florida Law
It might surprise you to learn that Florida law recognizes two forms of workplace sexual harassment.
Hostile Work Environment
Sexual harassment due to a hostile work environment includes a worker experiencing unwelcome sexual advances, verbal comments of a sexual nature and other misconduct that affects their employment or performance. For a claim to be valid, the misconduct must be severely offensive and pervasive, creating an intimidating and demeaning atmosphere. A single act or comment might not be actionable unless it involves severe misconduct, like unwanted sexual touching or fondling to the point of sexual assault. Other harassing misconduct can include displaying offensive pictures, emailing or messaging inappropriate jokes or making comments about an absent employee’s appearance. Additionally, harassment based on the victim’s sexual orientation could also create a hostile work environment.
Quid Pro Quo Sexual Harassment
Quid pro quo means “something for something.” In employment law, it refers to situations where an employer requests sexual favors in exchange for preferential treatment or threatens to fire or punish the employee if they refuse sex. Typically, a supervisor or person in authority preys on a lower tier employee. Examples include requiring a date to keep one’s job, requesting sexual favors for a raise or promotion and demanding sexual acts with the threat of termination. Quid pro quo harassment can occur even before hiring, such as requesting sexual favors as a condition of employment.
