LGBTQ tech workers face discrimination at work

On Behalf of | Jul 26, 2019 | LGBTQ Workplace Discrimination

Many members of the LGBTQ community in Florida face workplace discrimination. While gender discrimination is prohibited under Title VII of the Civil Rights Act of 1964, the U.S. Supreme Court has not ruled whether discrimination against gay and transgender people is a form of prohibited sex-based discrimination.

While the technology sector is widely perceived as being more inclusive, LGBTQ tech workers have reported a different story. Two former workers at Dell in New York have described unfair treatment by supervisors and coworkers.

One gender non-conforming woman who identifies as a woman but dresses like a man reports that Dell forced her to go into training for three years after her company, ECM, was merged with Dell. While other people were moved out of training and up in their careers, she was not. She also reported that she was heckled by her co-workers when she gave presentations. Another former Dell worker who is a systems engineer began to transition from male to female. When she was in the middle of her transition, Dell let her go. She has filed a lawsuit against the company.

Members of the LGBTQ community in Florida may face discrimination at their jobs. However, workplace discrimination assistance from an employment law attorney can help a victim recover damages by filing a claim against their employer. The attorney may start by reviewing the case and giving an honest assessment. If they agree to accept a client’s case, legal counsel may gather evidence that could lead to a settlement. The lawyer may also explain whether their client should pursue a claim through the EEOC or a state agency.
