Some cities and counties in Florida have LGBT worker protections

Many states have laws that protect LGBT employees from workplace discrimination. Unfortunately, Florida has no such statewide protection. This means it is legal to fire someone because of her or his sexual orientation or gender identity in Florida.

However, there are plenty of cities and counties that have ordinances protecting public and private LGBT workers.

Cities and counties with LGBT protection ordinances

The Florida municipalities that have ordinances for equal workplace rights include:

  • Atlantic Beach
  • Broward County
  • Gainesville 
  • Gulfport
  • Jacksonville
  • Key West
  • Lake Worth
  • Miami Beach
  • Monroe County
  • Palm Beach County
  • Pinellas County
  • Orlando
  • Tampa
  • West Palm Beach

However, there are more cities and counties that have protections for city and county workers but not private employers. 

Sex or gender discrimination

Even in cities and counties without such protections, LGBT workers may still be able to pursue discrimination claims and lawsuits. For example, federal and state law provide protections for discrimination based on sex or gender. Some instances of sexual orientation or transgender discrimination may fall into these protected categories. 

What to do about discrimination

Anyone who suffers occupational discrimination should document the situation in writing. Discriminated workers should also consider their various legal options. Workers who live in cities or counties with specific laws may have an easier time winning a case, but it is possible for LGBT workers across Florida to win discrimination claims. 

There is still a long way to go to ensure LGBT individuals enjoy complete protection at work, but there are ways to fight against discrimination now.
